Non Personal Information Versus Personal Information. The primary goal at Perfect57 MedSpa in collecting information from you is to provide you with a helpful and efficient experience while you are using the Website. In order to do this, what is collected by the Website are two types of information about you: Personal Information and Non-Personal Information.
(a) “Personal Information” what this refers to is information that lets us know the specifics of who you are and can be used to contact, identify, or locate you. The examples of Personal Information include, without limitation, your credit card number, your first name together with your last name, your mailing address and/or email address, and your phone number. Typically, we will collect Personal Information when you use the Website to make product purchases, fill out questionnaires or surveys, request catalogs, join our mailing list, correspond with us, enter one of our contests or sweepstakes, choose to submit testimonials, photos, stories, or the like to the Website, or otherwise volunteer information about yourself. If you have chosen to call any of our Skin Health Experts to receive personalized skin consultations or analysis or complete a questionnaire, we will also collect personal information related to your personal health such as: (i) age, (ii) gender, (iii) history of allergies, (iv) certain use of medication or drugs, and (v) any special health problems or concerns.
(b) “Non-Personal Information” is referred to as information that does not, on its own, identify you or any specific individual. An example of Non-Personal Information we may collect includes, without limitation, demographic information, which web pages of ours are most often visited, and which of our products are either receiving the most purchases or website visits. Any of the methods discussed above we may use to collect Non-Personal Information through, as well as automatically through the use of industry standard technologies discussed further below.

You agree that, to the fullest extent permitted by applicable law, we will not be responsible or liable (whether in contract, tort, or otherwise), under any circumstances, for any (a) interruption of business; (b) access delays or access interruptions to the site; (c) Any sort of loss or damages incurred as a result of dealings with or the presence of off-website links on the site; (d) Data non- delivery, misdelivery, corruption, destruction or other modification; (e) Computer viruses, system failures or malfunctions which may occur in connection with your use of the site, including during hyperlink to or from third party websites; (f) any inaccuracies or omissions in content or (g) events beyond our reasonable control.
With respect to any dispute regarding the Site, all rights and obligations and all actions contemplated by these Terms and Conditions shall be governed by the laws of New York, as if the Terms and Conditions were a contract wholly entered into and wholly performed within New York. If there is any dispute relating to in any way to your visit to the Site shall be submitted to confidential arbitration in New York, except that, to the extent you have in any manner violated or threatened to violate our intellectual property rights or the intellectual property rights of our affiliates, partners or licensors. If this happens, we may seek injunctive or other appropriate relief in any court and you consent to exclusive jurisdiction and venue in any such court. Any arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.
